These Terms and Conditions (“Terms”) govern your access to and use of the Unspoken Poetry platform (the “Platform”), including the website https://unspoken.ektukra.com/, our YouTube channel, poetry performances, events, poet submissions, newsletters, and any related services (collectively, the “Services”). The Services are operated by Ektukra (“we”, “us”, or “our”), a multimedia and digital agency based in Kathmandu, Nepal.
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Services.
1. Eligibility
You must be at least 13 years of age (or the minimum age required in your country) to use the Services. If you are under the age of majority in your jurisdiction, you must have permission from a parent or legal guardian to use the Services.
2. User Accounts and Poet Submissions
- Certain features (e.g., poet registration, event booking, newsletter subscription) may require you to provide accurate information.
- You are responsible for maintaining the confidentiality of any login credentials and for all activities under your account.
- When submitting poems, content, or applications to become a featured poet, you represent and warrant that:
- The content is original or you have all necessary rights and permissions.
- The content does not infringe any third-party intellectual property rights, privacy rights, or other laws.
- The content does not contain harmful, abusive, defamatory, obscene, or illegal material.
We reserve the right to review, accept, reject, edit, or remove any submitted content at our sole discretion without notice.
3. Intellectual Property
- All content on the Platform (videos, poems performed, graphics, audio, text, logos) is owned by Ektukra, the performing poets, or our licensors and is protected by copyright, trademark, and other intellectual property laws.
- You may view and listen to the content for personal, non-commercial use only.
- You may not reproduce, distribute, modify, create derivative works from, publicly display, or perform any content without our prior written permission or the permission of the respective rights holder.
- If you are a featured poet, we may credit you publicly and use your name, image (if provided), and submitted work in promotions related to the performance, subject to any specific agreement.
4. User Conduct
You agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable law.
- Harass, threaten, impersonate, or harm others.
- Upload viruses, malware, or any code that could damage the Services.
- Attempt to gain unauthorized access to any part of the Services.
- Scrape, crawl, or use automated means to extract data without permission.
- Interfere with the proper functioning of the Services.
We may suspend or terminate your access if we believe you have violated these Terms.
5. Third-Party Services
The Platform integrates with third-party services such as YouTube for video hosting and analytics. Your use of those services is governed by their respective terms and privacy policies (e.g., YouTube Terms of Service and Google Privacy Policy). We are not responsible for the practices or content of third parties.
6. Events and Tickets
- Event tickets or registrations are subject to availability and any additional event-specific terms.
- We reserve the right to cancel, reschedule, or modify events. In case of cancellation, we will make reasonable efforts to notify you and provide refunds where applicable.
7. Disclaimer of Warranties
The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Services will be uninterrupted, error-free, secure, or free of viruses.
8. Limitation of Liability
To the fullest extent permitted by law, Ektukra, its officers, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, even if advised of the possibility of such damages.
Our total liability to you shall not exceed the amount you paid us in the twelve (12) months preceding the claim (if any).
9. Indemnification
You agree to indemnify and hold harmless Ektukra and its affiliates from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.
10. Termination
We may terminate or suspend your access to the Services at any time, without notice, for any reason, including breach of these Terms.
11. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of Nepal. Any disputes arising out of or related to these Terms shall be resolved exclusively in the courts located in Kathmandu, Nepal.

We may update these Terms from time to time. Changes will be posted on this page with a revised “Last Updated” date. Your continued use of the Services after changes constitutes acceptance of the updated Terms.
